US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.

The case stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.

In her order, the court pointed out that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.

The court, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
